Welcome to Holy Fizz! These Terms of Service ("Terms") govern your use of our services, including online ordering, event bookings, and in-person purchases. By using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Holy Fizz services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Services Offered

Holy Fizz provides:

Beverage sales through our mobile food truck
Online ordering for pickup
Event booking and catering services
In-person point-of-sale transactions
Self-service ordering at events

3. Orders and Payments

Order Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, or suspected fraud.

Pricing and Taxes

All prices are listed in USD and are subject to change without notice. Sales tax will be calculated based on the location of service and added to your total.

Payment Methods

We accept cash and major credit/debit cards. Payment must be completed at the time of order. For event bookings, deposits may be required.

Pickup Orders

Pickup orders must be collected within the specified time window. Unclaimed orders may be disposed of without refund after 30 minutes past the scheduled pickup time.

4. Event Bookings

Booking Process

Event booking requests are subject to availability and approval. A deposit (typically $200) may be required to confirm your booking. The deposit is non-refundable unless we cancel the event.

Cancellation Policy

Cancellations made 14+ days before the event: Full refund minus deposit
Cancellations made 7-13 days before: 50% refund
Cancellations made less than 7 days before: No refund

Client Responsibilities

You must provide accurate event details, ensure adequate space and access for our truck, and comply with all venue requirements. You are responsible for obtaining necessary permits or permissions.

5. Refunds and Returns

Due to the nature of food and beverage products, we do not offer refunds or exchanges except in the following circumstances:

Product quality issues (must be reported immediately)
Order errors made by Holy Fizz
Service failures (at our discretion)

Refund requests must be made at the time of service or within 24 hours. Approved refunds will be processed to the original payment method within 3-5 business days.

6. Food Allergies and Dietary Restrictions

Our products may contain or come into contact with common allergens including dairy, nuts, soy, and other ingredients. If you have food allergies or dietary restrictions, please inform our staff before ordering. We cannot guarantee that any product is allergen-free.

By placing an order, you acknowledge that you have been informed of potential allergen risks and assume all responsibility for adverse reactions.

7. Intellectual Property

All content on our website and services, including logos, designs, text, and images, are the property of Holy Fizz and are protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Holy Fizz shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages arising from food allergies or dietary reactions (provided we have given proper warnings)
Service interruptions or unavailability
Acts of God, weather events, or circumstances beyond our control

Our total liability for any claim shall not exceed the amount paid for the specific order or service in question.

9. User Conduct

You agree not to:

Use our services for any unlawful purpose
Provide false or misleading information
Interfere with or disrupt our services
Attempt to gain unauthorized access to our systems
Harass or abuse our staff or other customers

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Alabama. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
